Terms of Service

These Terms of Service (“Terms”) govern your access to and use of mepselect.com and any related services (collectively, the “Services”) provided by MEPSelect (“MEPSelect,” “we,” “us,” or “our”). By using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Services. The Services are intended for use within the United States only.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@mepselect.com if you suspect unauthorized use.

3. Products, Quotes, and Pricing

MEPSelect helps customers select installable equipment such as HVAC systems and related mechanical, electrical, and plumbing products. Product descriptions, specifications, availability, and pricing are subject to change without notice. We strive for accuracy but errors may occur — we reserve the right to correct errors and to refuse, modify, or cancel any order placed at an incorrect price or based on inaccurate information.

Quotes are valid for the period stated on the quote. Equipment recommendations are based on the information you provide and do not replace a site evaluation by a licensed professional.

4. Orders and Payment

Submitting an order constitutes an offer to purchase. An order is accepted only when we send an order confirmation. We may decline or cancel orders at our discretion, including for suspected fraud, inventory issues, or pricing errors.

You agree to provide current, complete, and accurate billing information and authorize us (and our payment processor) to charge your selected payment method for all amounts due, including applicable taxes and shipping.

5. Shipping, Delivery, and Risk of Loss

Shipping costs are calculated at checkout and depend on the equipment, destination, and delivery method. Risk of loss and title for purchased equipment pass to you upon delivery to the carrier unless otherwise stated. See our Shipping Policy for additional details.

6. Returns

Returns are handled on a case-by-case basis and are subject to a 10% restocking fee. See our Returns & Refunds Policy for full details.

7. Installation and Professional Services

Installable equipment sold through MEPSelect must be installed, serviced, and maintained by appropriately licensed professionals in accordance with manufacturer specifications and applicable code. MEPSelect does not perform installation and is not responsible for the work of any contractor, installer, or third party. Improper installation may void manufacturer warranties.

8. Warranties

Equipment sold through MEPSelect carries the warranty offered by its manufacturer. Warranty terms, durations, and claim procedures vary by manufacturer and product. Except as expressly provided by a manufacturer warranty or by applicable law, the Services and all products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, MEPSelect and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Services or any product purchased through the Services. Our total liability for any claim arising out of or related to the Services or a product will not exceed the amount you paid for the product giving rise to the claim.

10. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose.
• Attempt to access accounts, systems, or data that you are not authorized to access.
• Interfere with or disrupt the Services or any servers or networks connected to them.
• Scrape, copy, or resell content from the site without our written permission.
• Submit false, misleading, or fraudulent information, including during quote or order requests.

11. Intellectual Property

All content on the Services — including text, graphics, logos, images, product information, and the MEPSelect name and logo — is owned by MEPSelect or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

12. Third-Party Links and Services

The Services may link to or integrate with third-party websites, manufacturers, contractors, payment processors, or analytics providers. We are not responsible for the content, accuracy, or practices of those third parties.

13. Privacy

Our Privacy Policy explains how we collect, use, and protect your information and is incorporated into these Terms by reference.

14. Indemnification

You agree to indemnify and hold harmless MEPSelect and its officers, employees, and affiliates from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida for any dispute arising out of or relating to these Terms or the Services.
